WEDDING PHOTOGRAPHY/VIDEO CONTRACT

TERMS & CONDITIONS

In the following terms & conditions "Photographer/Videographer" shall mean Mike Atkinson & Tony Atkinson of Twisty Focus weddings trading as Twisty Focus. "The client(s)" shall be those persons defined as the bride and groom in the wedding booking. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification shall be effective unless agreed by both parties in writing.

Deposit Payments & Final Bill

Deposit Payments & Final Bill

A deposit is required to secure the booking of wedding photography/videography but the amount can be chosen by the client(s) as this amount will be taken off the final bill. Any amount left to pay by the client(s) can be paid anytime up to the day before the wedding day.

Wedding arrangements

The details of the wedding arrangements are to be agreed beforehand in writing (email is acceptable). The client(s) shall notify the Photographer/Videographer of any changes to these details in writing.The Photographer/Videographer cannot be held liable for delays or disruption in their delivery of the service until any changes are received, and acknowledged in writing.

Cancellation

The Client may cancel this contract at any time by giving written notice to The Photographer/Videographer but in doing so shall forfeit any payments made. Cancellation less than 12 weeks before the wedding will result in the payment in full becoming due. All cancellations must be in writing (Email is acceptable).

 

Display/use of images & video

The Photographer/Videographer may display any photographs/videos to promote the business in advertising, brochures, magazine articles, websites, social media, sample albums etc unless told otherwise. If the client(s) do not want to give the Photographer/Videographer consent to use their wedding photographs and videos on this website, on social media etc they MUST state so in writing (Emails are acceptable).

Photography/Filming at venue

For a booking involving a church ceremony or at certain venues, the photographer/videographers movements are sometimes restricted by the official in charge aswell as the use of flash/artificial lighting which may effect the quality of the images/video in low light conditions.The area from which the photographer/videographer is able to cover the ceremony may not be the photographer/videographers choice and the photographer/videographer cannot accept responsibility for any obstructed view should this be the case.

The style of photography/videography the Photographer/Videographer will shoot will be natural/documentary, if the Client wants any specific photos/video i.e rings, dress, group photos and anything else they must submit to the Photographer/Videographer in writing and be agreed before the wedding day or the photographer/videographer cannot be held liable.

Video

All wedding videos are 6-7min long and include footage of the day which is then edited to music which is chosen by the photographer/videographer. no sound is recorded at the wedding nor will it be used in the final video i.e ceremony, speeches etc. The final video will be supplied on a usb drive or dvd.

Final images

All final images are supplied to the client on a usb drive in both colour and black & white. The amount of images supplied by the Photographer/Videographer shall be deemed correct.

Copyright​

The copyright Designs and Patents Acts assign the copyright of the images to the Photographer/Videographer. Any images/videos or copies of images/videos whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images/video are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image/video created as part of this contract without the permission of the Photographer/Videographer in writing.

Attendance

In the unlikely event of the assigned Photographer/videographer being unable to attend your wedding due to unforeseen circumstances, the Photographer/Videographer reserve the right to appoint another photographer/videographer to attend your wedding on our behalf to undertake the wedding photography/videography to his/her best ability.

The weather is out of the photographer/videographers control, if the weather effects the ability to capture certain photos/videos the client(s) requested, the photographer/videographer holds no responsibility, e.g if it's raining and group photos outside are

not possible.
